Terms of Service

1. Agreement to terms

By accessing wesellit.agency or engaging WeSell It LLC ("WeSell It," "we," "us," or "our") for marketing services, you ("you" or "Client") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the site or our services.

2. Services

WeSell It provides paid advertising management (Meta Ads), social media management, video production, and content strategy services. Specific deliverables, timelines, and fees are described in a separate engagement letter or proposal between WeSell It and the Client.

3. Communications and SMS messaging

When you contact us through our website form, request a quote, or otherwise provide your phone number, you consent to receive communications from WeSell It related to your inquiry, including by phone call, email, and SMS text message.

Our SMS program is conversational and transactional only. We use SMS to confirm inquiries, schedule and confirm meetings, follow up on quotes and proposals, deliver project updates, and respond to your questions. We do not send promotional broadcasts via SMS.

  • Message frequency varies based on your interaction — typically 1-4 messages per week during active engagement.
  • Message and data rates may apply per your mobile carrier's plan. WeSell It does not charge for SMS.
  • Opt out: reply STOP to any SMS to immediately stop messages. Reply HELP for assistance.
  • We do not share your mobile information or opt-in consent with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy §4 for the full SMS data-handling policy.

4. Payment

Fees are due according to the terms of your engagement letter. Late payments may be subject to a 1.5% monthly service charge. Failure to pay may result in suspension or termination of services.

5. Client responsibilities

The Client is responsible for providing timely access to advertising accounts, brand assets, approvals, and any third-party platform credentials reasonably necessary for WeSell It to perform the services. The Client warrants that all materials provided to WeSell It are owned by or licensed to the Client and may be used in marketing campaigns.

6. Ad spend

Unless otherwise stated, paid media spend is billed directly to the Client by the advertising platform (Meta, Google, etc.) using a credit card or billing arrangement controlled by the Client. WeSell It does not hold or front Client ad spend.

7. Ownership of work product

Final, paid-for creative deliverables (videos, photos, written copy, graphic designs) become the Client's property upon full payment. WeSell It retains the right to display non-confidential work in our portfolio and case studies unless the Client objects in writing.

8. Confidentiality

WeSell It will treat non-public business information shared by the Client as confidential and will not disclose it to third parties except as needed to perform the services or as required by law.

9. Disclaimer of warranties

Marketing results depend on factors outside our control, including market conditions, audience response, and the Client's offer. WeSell It does not guarantee specific results, lead volume, or revenue. Services are provided "as is" without warranty of any kind.

10. Limitation of liability

In no event will WeSell It's total liability to the Client exceed the fees paid to WeSell It in the three (3) months preceding the event giving rise to the claim. WeSell It is not liable for indirect, consequential, or incidental damages.

11. Termination

Either party may terminate an engagement with thirty (30) days written notice unless otherwise stated in the engagement letter. Fees for work performed through the termination date remain due.

12. Governing law

These Terms are governed by the laws of the State of Texas. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Hidalgo County, Texas.

13. Changes to these terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date.
